Growing up I watched television shows and movies such as To Kill A Mocking Bird, Perry Mason, and Matlock. These lawyers had very different personalities, but there’s something they shared: they were skilled, smart trial lawyers. Hollywood embellished the trial process, but lawyers during that era were trial lawyers first. Lawyers were expected to know how to try cases well for their clients.

The legal profession has changed dramatically. Many lawyers never see the inside of a courtroom. They can practice law from their offices and never know the thrills of winning a trial or chills of losing one. 

Trials are for litigators, and many lawyers are no longer litigators. Some areas of the law don’t need litigators, but others do. Those areas that are litigation intensive such as personal injury, criminal defense, family law, and others need skilled, smart trial lawyers.

I suppose it’s similar to the confidence a surgeon feels knowing she can perform surgery or the confidence any professional experiences knowing she possesses the basic proficiency to perform her job. Also, our opponents note our ability to try cases. They know we aren’t afraid to reject offers and go to trial. Hence, they give us better and more reasonable offers.
