Better Offers and Better Verdicts

Growing up I watched television shows and movies such as To Kill A Mocking Bird, Perry Mason, and Matlock. These lawyers had very different personalities, but there’s something they shared: they were skilled, smart trial lawyers. Hollywood embellished the trial process, but lawyers during that era were trial lawyers first. Lawyers were expected to know how to try cases well for their clients.

The legal profession has changed dramatically. Many lawyers never see the inside of a courtroom. They can practice law from their offices and never know the thrills of winning a trial or chills of losing one. 

Trials are for litigators, and many lawyers are no longer litigators. Some areas of the law don’t need litigators, but others do. Those areas that are litigation intensive such as personal injury, criminal defense, family law, and others need skilled, smart trial lawyers. 

They know we aren’t afraid to reject offers and go to trial.

Below I outline four benefits to our clients that we’re skilled, smart trial lawyers. We’re happy to wear this distinction, but this honor means nothing if it doesn’t benefit our clients. Let’s take a look:

1.    Fearless advocacy

Fearlessness comes from knowing how to try a case. I suppose it’s similar to the confidence a surgeon feels knowing she can perform surgery or the confidence any professional experiences knowing she possesses the basic proficiency to perform her job. Again, the same is true for trial lawyers. That confidence is priceless because it checks fear and makes practicing law enjoyable.

2.    Better offers

Also, our opponents note our ability to try cases. They know we aren’t afraid to reject offers and go to trial. Hence, they give us better and more reasonable offers. No more throwing us crappy offers knowing we’ll take them to avoid trials. This respect for our trial skills benefits our clients tremendously as insurance companies and district attorney offices know better than to insult us and our clients with ridiculous settlement and outrageous plea bargain offers.

Instead, they know delaying the process will only give us more time to prepare, prepare and prepare.

Not only will the offers improve but the verdicts will also. Juries feel more comfortable giving us what we ask for knowing and seeing we’re skilled, smart lawyers. Every case is different, and sometimes the best trial lawyers lose trials. So, hiring a skilled, smart lawyer guarantees no win at trial, but it increases the chances of winning and getting favorable jury verdicts. This opportunity to win and get favorable jury verdicts also greatly benefits our clients.

4.    Quicker results

Another benefit to our clients from us being skilled, smart trial lawyers is we resolve cases faster. Here’s the reason for that. Opposing counsel or insurance adjusters know there’s no reason to delay the process or waste time with gamesmanship or antics. They know more time will not increase their chance of winning. Instead, they know delaying the process will only give us more time to prepare, prepare and prepare. They’re just delaying the inevitable, which is allowing us a more significant opportunity to present our case to a jury and potentially get an even better outcome than they’re offering.

We don’t boast about being the greatest or best trial lawyers. However, we aren’t bashful about saying we’re skilled, smart trial lawyers. We’ve tried enough cases to make such a claim. Yes, we’re still learning and growing as trial lawyers and always will be. We’ll never stop sharpening our trial skills. Yet we’re confident that we can put our trial skills up against anyone and give our clients a high chance of obtaining a fantastic result especially when the law and facts are on our side.
